KRISPAH NEVER PAID DEXTA BRIYANKA SH200,000 TO WITHDRAW COPYRIGHT CLAIM SAYS HIS LAWYER LIZ LENJO
Musician Krispah has dispute claims that he paid upcoming artiste Dexta Briyanka Sh200,000 to withdraw a copyright claim over his song Ndovu Ni Kuu.
Through his lawyer, Liz Lenjo, she said the upcoming artiste was willing restore the song on YouTube after being served with a demand letter from Krispah’s legal counsel. “As a professional artist, Krispah sought legal counsel with us, and we immediately wrote a demand letter asking Dexta to withdraw the false and misleading claim and restore our client’s content.
It is an offence under the Copyright Act Section 35B (8) and has criminal sanctions of a fine not exceeding Sh 500,000 or imprisonment of a term not exceeding 5 years or both. On Tuesday 20th, Dexta called our client via his management team, that he shall withdraw his claims immediately and restore our client’s song on YouTube,” said the lawyer.
Krispah has also forgiven Dexta adding that he will not sue him as long as he stops making false statements about him. “No monetary or other arrangements were made with him as he has no entitlements to any part of the song. We hope he shall cease and desist from making false statements and claims in the public domain. Our client has extended an olive branch to Dexta and will not sue him both for criminal and civil wrongs for as long as he refrains from making false statements and he sets the record straight,” added Liz.
Ndovu Ni Kuu song was pulled down from YouTube on Friday, July 16 following a copyright strike by Dexta on claims that Krispah sampled his beats. “Dexta filed a false claim with YouTube to the effect that there was a copyright infringement on his work, by Ndovu Kuu in this song. It was baffling to our client given that all the original masters and recordings were created by Ndovu Kuu. In addition, the song had been on YouTube and had even trended on other platforms like Tiktok for more than a month, with no complaint from Dexta or anyone else,” concluded Lenjo.
