KMPDC ORDERS CLOSURE OF BODY BY DESIGN DUE TO VIOLATIONS

The Kenya Medical Practitioners and Dentists Council (KMPDC) has issued an official closure notice to Body By Design, also known as Omnicare Medical, effective immediately. 

The closure follows findings of significant violations of the Medical Practitioners and Dentists Act, CAP 253. The KMPDC notice cited the following infractions under CAP 253: Unlawful operation of an unlicensed health institution: Body By Design was found to be operating as a health institution without the required licensing under section 15(11) of CAP 253.

Employment of unregistered medical practitioners: Omnicare Medical was found to have engaged individuals who were not registered and licensed as medical practitioners or dentists, in contravention of section 22(4) of CAP 253. Failure to meet required healthcare standards: The facility did not adhere to mandated health standards and protocols outlined in the Medical Institution Rules under CAP 253, raising concerns about patient safety and care quality. 

This enforcement action follows a tragic incident involving the passing of a patient, Lucy Wambui, after a procedure at Body By Design. According to initial reports, Wambui received care from a practitioner allegedly not certified as a plastic surgeon. Complications arose when Wambui reportedly suffered from perforated intestines, leading to a severe infection and eventual hospitalisation in the ICU, where she passed away days later. 

In response to the tragedy, Body By Design released a statement expressing condolences to Wambui’s family, stating, “We are deeply saddened to announce the passing of one of our patients, Lucy Wambui, under circumstances that are currently undetermined. Our hearts go out to the family and friends of the deceased, and we extend our sincerest condolences during this difficult time.” 

The institution also confirmed that she had successfully undergone a procedure and was discharged before her health deteriorated. Body By Design has launched an internal investigation in cooperation with relevant authorities to ensure a full review of the events surrounding Wambui’s case. “Our top priority at Omnicare Medical Limited is the well-being and safety of our patients, we are unable to provide other details at this time, we appreciate the public understanding and patience, and we will share additional information as it becomes available.”
