COURT ORDERS EDGAR OBARE TO PAY BERNICE NUNAH SH6 MILLION IN DEFAMATION CASE
A Nairobi courts has ordered controversial blogger Edgar Obare to pay digital creator Bernice Nunah a total of KSh 6,096,658 in damages and to issue a full public apology for publishing defamatory content against her.
The judgment, delivered by Hosea Mwangi Nganga on November 7, 2025, brings to a close a long-running legal battle initiated by Nunah over posts made by Obare on his platforms in December 2022.
According to the court decree, Obare has been directed to “make a full and unqualified apology, make amends and withdraw the publication/broadcast” from the 1st, 2nd and 5th of December, 2022. The court mandated that this apology must be circulated through the same online platforms where the original posts were made.
The court awarded Nunah a financial compensation. She is to receive KSh 2,000,000 as general damages for libel and an additional KSh 1,000,000 in exemplary or aggravated damages. With interest calculated at 12% from the date of the judgment, the total monetary award amounts to KSh 3,096,329.
The decree also includes a permanent injunction, legally restraining Obare, his agents, or anyone acting on his instructions from further publishing or broadcasting the defamatory statements or any similar words against the plaintiff.
The court further awarded Nunah the costs of the suit, certified at KSh 386,700, which covers legal fees, court filing fees, and other disbursements related to the case. This ruling underscores the legal repercussions of publishing defamatory content online and reinforces the responsibility of digital content creators to adhere to laws .
