COURT ORDERS ANERLISA MUIGAI TO PAY BEN KANGANGI SH2 MILLION IN DEFAMATION CASE

Businessman Ben Kangangi has been awarded Sh2 million in damages after winning a defamation lawsuit against Keroche heiress Anerlisa Muigai.

Kangangi filed a lawsuit against Anerlisa on March 22, 2018 seeking general damages, damages  or the loss of reputation, exemplary damages, a written apology and a permanent injunction after Anerlisa wrote an online post on Facebook and Instagram.

According to Kangangi since the publication of the online posts, he has been greatly injured in character and reputation as a consequence, he had been brought into the public ridicule and contempt in the eyes of the right thinking members of society. He stands to lose considerable business opportunities as a result of his damaged reputation. 

On March 31 a Nairobi court ordered Anerlisa to pay Kangangi Sh2 million in damages, “On plain reading of the post, it is this court’s view that it was indeed defamatory. The post directly referred to the plaintiff and indicated that he was an unscrupulous businessman who conducted fraudulent business and could not be trusted. The plaintiffs indicated that the claims by the defendant were false and the defendant did not provide anything to controvert the same. 

The post was picked by several media outlets. I am satisfied that in the absence of any contrary evidence the plaintiff was defamed as the evidence on record does not prove that the plaintiff character was negatively affected. Given the evidence on record I do find that a global  award of Sh2,000, 000 shall be adequate compensation for the plaintiff.” Said Justice Chitembwe.
