EDDIE BUTITA TAKES LEGAL ACTION AGAINST TOP ONLINE BRAND FOR USING HIS BRAND NAME

TV personality Eddie Butita has taken legal action against online brand Mall of Africa for using his brand name ‘Eddie Butita’ to promote their Black Friday campaign without his permission.

The company used his name on three of its official online platforms: Twitter, Facebook and Instagram. Butita share a letter drafted by his lawyers, “On 22nd October 2020 in anticipation of the international Black Friday you exploited our client’s widely renowned brand to market your business and attract shoppers.

While using our client’s brand, you posted promotional content on all your social media platforms: Facebook business page Mall of_Africa, Twitter Handle @MFA_Kenya and Instagram account @Mall of Africa-Kenya inviting buyers to visit and shop on your online shops during the Black Friday shopping extravaganza.” The letter read in part.

Adding, “Take note that we have been instructed to demand which we hereby do, for your written admission that your actions amount to unlawful commercialization of our client’s brand.

We shall therefore engage on the amount of compensation due to our client. In the absence of your admission, we the firm instructions to commence judicial proceedings to enforce our client’s right to your detriment as to costs and other incidentals.”
