Nairobi car dealer Joseph Wambui, popularly known as Khalif Kairo, has had two fraud cases totalling Sh.5.9 million withdrawn after he reached an out-of-court settlement with the complainants.

The charges were formally dropped on Monday at the Milimani Law Courts before Chief Magistrate Lucas Onyina. The court was informed that the businessman had fully reimbursed the two individuals who had accused him of failing to deliver imported vehicles after payment.

My client has refunded the complainants through their advocate, and they are not pursuing the cases further,Kairo’s defence team told the court.

Magistrate Onyina ordered the termination of the criminal proceedings under Section 204 of the Penal Code, which permits charges to be withdrawn when a mutual agreement is reached.

In the first case, Kairo, operating through his company Kai & Karo Limited, was accused of obtaining Ksh.2.98 million from Dona Ayalo Okoth to import a Subaru Outback. The vehicle was never delivered. A second case involved Ksh.2.15 million obtained from Jeff Kyule Munane for a Honda Vezel Hybrid that also never delivered.

Kairo had pleaded not guilty to all charges upon his arraignment. The court was made aware that a third, separate case against him remains active and is scheduled for mention in December 2025.
